How Much Does It Cost to File a Condo Offering Plan in New York?

Updated · 5 min read

Short answer: For a condo offering plan submitted to the New York State Attorney General on or after November 5, 2025, the filing fee is 0.4% of the total offering price, with a $750 minimum and a $60,000 maximum, and every amendment costs $750. Any offering of $15,000,000 or more hits the cap, so the fee weighs most on mid-size buildings: the median NYC condo plan accepted since 2020, with a total offering price of about $9,300,000, would owe about $37,320 at today's rates.

How the Filing Fee Is Calculated

The fee depends on the total offering price and on when the plan was first submitted. The current schedule, from REF's fee memorandum issued October 30, 2025:

Plan submittedRateMinimumMaximum
On or after Nov 5, 20250.4%$750$60,000
Apr 23, 2008 to Nov 4, 20250.4%$750$30,000
Aug 13, 2003 to Apr 22, 20080.4%$750$20,000
Apr 1, 1989 to Aug 12, 20030.2%$500$20,000
Before Apr 1, 19890.1%$500$10,000

A few worked examples at today's rates:

The fee is set by General Business Law § 352-e(7), and the Attorney General's Real Estate Finance Bureau (REF) collects it. The total offering price is the sum of the sponsor's prices for every unit, the figure on the plan's cover and in Schedule A.

The cap is why the fee hits mid-size buildings hardest. The median NYC condo plan accepted since 2020 has a total offering price of about $9,300,000, which would owe about $37,320 at today's rates. A tower pays the same $60,000 as a $15 million building: on the Morgan's $358,036,300 offering (CD250420), that's 0.017% of the sellout. And the November 2025 increase from a $30,000 to a $60,000 cap raised the bill on every offering over $7.5 million, which is 61% of recent NYC plans; 34% are big enough to pay the full $60,000.

When the Fee Is Paid

Half the fee is a nonrefundable deposit, paid when the plan is submitted for review. The other half is due when the Attorney General issues the letter accepting the plan for filing. If a plan is withdrawn or never accepted, the deposit is not returned.

Under REF's memorandum, the date that counts is when REF accepts the submission, not when it first arrives. A plan received before November 5, 2025 but held back as administratively deficient until after that date pays the new, higher fee.

What Amendments Cost

Every amendment to an offering plan carries a flat $750 fee when submitted on or after November 5, 2025, up from $225, even when the plan was accepted years ago.

An amendment that raises the offering price can owe more. If the sponsor hasn't yet paid the maximum fee, REF charges the extra percentage fee on the higher total, up to the cap that was in effect when the original plan was submitted. Since November 5, 2025, REF uses that original plan's cap rather than the cap in effect when the amendment is filed, which for older plans means a lower bill. Once the cap has been paid, later price increases owe only the $750 amendment fee.

What the Filing Fee Doesn't Cover

The Attorney General's fee is only the government's charge. The real cost of a condo book is in preparing it: the sponsor's offering plan attorney drafts the plan, an architect or engineer prepares the building description, and the budget in Schedule B needs supporting work. Those are private fees, they vary by project, and the plans themselves rarely disclose them. You can see who did the work on any building: each plan on The Condo Book Project lists its offering plan attorneys, architects and managing agents.
